Mediation

Western North Carolina Mediation Attorneys

George W. Moore at The Moore Law Office, PLLC is a Certified Mediator. Mediators are certified by the North Carolina Dispute Resolution Commission. Mediation is required for cases pending before the Superior Courts and Workers' Compensation cases under the jurisdiction of the Industrial Commission.

Mediation is a process to resolve legal disputes without incurring the time and expense that trials require. It is of great benefit to the litigants, their counsel, and the court system. The mediated settlement conference affords the parties an excellent opportunity to resolve their case and avoid the stress, expense, and time necessary to engage in trial preparation and trial.

In mediation, the mediator works with the parties to help them explore settlement, reconciliation, and understanding. The mediator's role is to facilitate communication between the parties and to assist them in resolving the issues in dispute. The mediator assists the parties in identifying issues, reducing obstacles to communication, and maximizing the exploration of alternatives. A mediator does not render decisions on the issues in dispute. The parties have the responsibility for the resolution of the dispute. The mediator is present to assist them.

The parties to a law suit or Workers' Compensation claim have the opportunity to select a mediator. If the parties fail to agree on a mediator within the specified time period, the resident Superior Court judge or the Industrial Commission will select a certified mediator to serve in their case.

Pursuing Divorce through Mediation

In divorce it is important to put the needs of the children and the family first. If the parties can come together to hammer out a divorce agreement, you will have an agreement that you crafted, not a judgment issued by an official who does not know you, your family or your personal preferences.

Because the two of you do the negotiating you are less likely to pursue modifications later or change your mind about the child visitation agreement.

Mr. Moore is certified by the North Carolina Dispute Resolution Commission, and receives periodic refresh training.
